How do I go about handling this with Subaru warranty?

hi,
husband owns 2005 subaru wrx. has 52,000 miles on , transmission blew. took subaru dealership, , inspected problem , called saying subaru declined work on car warranty (we still have 60,000 powertrain factory) because husband has different exhaust on car , said there metal shavings in transmission fluid. in may of year, clutch went out, bought new one, had installed @ body shop , changed transmission fluid. have reciepts , showed them. subaru says have proof , pictures (?) of other cars show think caused husbands "hard" driving , way drove car , , assuming him having exhaust. want pay $5,300!!! can do? ridiculous, husband bought used, , got extended warranty on it. there nothing else done car except has aem (?) intake on it, bought car on already. please help.
